Brian McDonagh, 26, of The Steeples, Navan, Co. Meath, was charged with stealing a bottle of Smirnoff Ice from Costcutter, Clanbrassil Street, Dundalk, on 2 December 2021. He was also charged with failing to appear before the court on bail 13 days after the theft. At a hearing in Dundalk district court in March 2022, his solicitor told the court he had tested positive with an antigen test that morning, but Judge Eirinn McKiernan refused to accept the result and a bench warrant was issued. McDonagh subsequently arrived in court, opted for trial in the Circuit Court, and the case was adjourned to 27 April 2022 for preparation of a book of evidence.
