latest first- court of appeal upholds refusal of residence permission for Brazilian man Immigration (refusal of residence permission)
Tiago Da Silva Mascarenhas, a 39-year-old Brazilian national who has lived in Ireland for 16 years, married an EU national in 2011 and was granted five-year residence permission. His wife left the State shortly after the marriage, and he admitted to the GNIB in 2017 that the marriage was one of convenience. The Minister for Justice refused his residence permission in 2019, and the High Court found no error in that decision. The Court of Appeal, in a judgment delivered in October 2022 by Ms Justice Aileen Donnelly, upheld the refusal and awarded the Minister her costs. After the appeal was heard, Mascarenhas obtained Portuguese citizenship and the Minister withdrew a proposal to deport him.
