latest first- High Court finds €1m in proceeds of crime assets in Dublin Proceeds of crime · Co. Dublin
The Criminal Assets Bureau sought to seize approximately €1.7 million in assets, including a property in Garristown, lands in Rush, a house on Deanstown Road in Finglas, vehicles, watches and jewellery, from Ross Browning, a 37-year-old Irish man described as a senior member of the Kinahan organised crime gang. The assets were seized in a 2018 raid, and CAB brought proceedings under the 1996 Proceeds of Crime Act, with family members including his mother Julie Conway and cousin Ian O'Haire contesting some claims. The High Court hearing before Justice Alexander Owens opened on 20 October 2022, and the judge reserved his judgment after hearing submissions from both sides. On 15 February 2023, the court ruled that more than €1 million of the assets were obtained with the proceeds of crime, directing limited payments to family members for their contributions.
In court, 20 Oct 2022Victim · 1 report - Man sentenced for criminal organisation role in foiled murder plot, Dublin Participating in activities of a criminal organisation (Section 72(1)(A) Criminal Justice Act) · Co. Dublin
The Kinahan crime organisation plotted to murder James Gately, a Hutch gang member, in Belfast between December 2016 and April 2017, following the Regency Hotel killing of David Byrne in February 2016. Estonian hitman Imre Arakas was brought to Ireland on 3 April 2017 to carry out the killing but was arrested at Blakestown, Dublin, the following morning, and Gately survived a second attempted murder in May 2017, being shot five times while wearing a bulletproof vest. Arakas was jailed for six years in December 2018, and Peter Keating, 40, David Duffy, 33, Stephen Fowler, 62, and Douglas Glynn, 37, were all sentenced at the Special Criminal Court between 2021 and 2022 for their roles in the foiled plot. Glynn, who placed a tracker device on Gately's car in Belfast, was sentenced to seven years and six months with the final year suspended on 14 February 2022. Martin Aylmer, 35, remains charged with participating in the plot.
Sentenced, 30 Jul 2021Convicted, suspect · 9 reports - Case adjourned over Garda retention of car in Dublin Abuse of authority (vehicle seizure and retention); property rights · Co. Dublin
Stephen Fowler, 62, from Clonsilla, Dublin 15, gave his friend Gary Byrne of Raheny, Dublin 5, full permission to use his 2014 registered Brown Skoda Octavia while he served a sentence in Portlaoise Prison. On 31 October 2021, the Gardaí detained and seized the car, questioning the validity of its insurance. Fowler and Byrne brought judicial review proceedings against the Garda Commissioner, with counsel arguing the seizure and continued retention amounted to a clear abuse of authority. Mr Justice Charles Meenan granted ex-parte permission to bring the challenge and adjourned the case to a date in February. Fowler was previously jailed for his role in a foiled murder plot connected to the Kinahan organised crime organisation.
In court, 13 Dec 2021Convicted · 1 report - Man sentenced for criminal organisation role in Dublin Participating in activities of a criminal organisation (Section 72(1)(A) Criminal Justice Act) · Co. Dublin
Stephen Fowler, 62, was sentenced on 4 October 2021 to six years and nine months, with the last 15 months suspended for three years, for participating in the activities of a criminal organisation in a plot to murder James Gately, a rival Hutch gang member living in Belfast, between December 2016 and April 2017. Fowler, of Blakestown Cottages, Clonsilla, Dublin, pleaded guilty at the Special Criminal Court in September 2021 to his logistical role in collecting Estonian hitman Imre Arakas and allowing him to stay overnight at his home. The plot was foiled when gardaí arrested Fowler and Arakas on 4 April 2017 after monitoring Arakas's arrival at Dublin Airport. Fowler is the sixth man jailed in connection with the failed Kinahan cartel attempt on Gately's life.
