  • Supreme Court finds State delayed unreasonably in Irish translation of Act Constitutional challenge (Irish language rights / translation of legislation) · Co. Dublin

Siobhán Denvir-Bairéad and her companies Gleann Mór Céibh Teoranta and Gleann Mór Cuan Teoranta sought Irish translations of the Planning and Development (Amendment) Act 2018 and various statutory instruments, which were not made publicly available until April 2020 despite the Act being signed in July 2018. Ms Justice O'Hanlon ruled in May 2021 that the State was obliged to provide Irish versions of the planning documents. The State brought a direct appeal to the Supreme Court, bypassing the Court of Appeal, arguing that Article 25 translation obligations apply only to Acts of the Oireachtas, not statutory instruments. In November 2022, the Supreme Court found the State delayed unreasonably in providing the Irish translation of the Act while limiting the scope of translation obligations to statutory instruments with special status under section 3 of the European Communities Act 1972.
