Sharda Sobhy, a chef from Mauritius, worked in Ireland without a valid work permit between 2012 and 2019 after studying and working lawfully from 2008 to 2012. She regularised her residency in 2019 and applied for maternity benefit, but her application was refused and the refusal was upheld on appeal. The High Court remitted the matter for further consideration, and on 16 December 2021 the Supreme Court unanimously dismissed her appeal, ruling that PAYE and PRSI payments made during her period of unlawful work could not be considered for social welfare payments.
