Shane Carroll, a 39-year-old farmer from Funshog, Collon, was stopped by a garda on 7 August 2022 at Silver Hill, Bohernamoe, Ardee, after his Toyota HiLux was observed swerving from left to right with brake lights activated. The garda noted a smell of alcohol, slurred speech, bloodshot eyes and unsteadiness, and Carroll was arrested on suspicion of drink driving before failing a breath test at Dundalk Garda Station. The defence argued the swerving was caused by potholes on the rural road and that there was an unjust delay in processing the defendant. The prosecution was dismissed at Dundalk District Court on 9 August 2022 because the garda who administered the breath test was unavailable to give evidence.
