Cases
latest first- Supreme Court declines appeal over mortgage possession order in Navan Possession order (mortgage dispute) · Co. Meath
Ben Gilroy, a former election candidate and anti-eviction activist, and his wife Sarah Jane Gilroy had a mortgage advanced by Start Mortgages DAC in 2007 for their home in Navan, Co Meath, and fell into arrears without making repayments for many years. Start Mortgages DAC obtained a possession order from the Circuit Court, which the couple challenged, alleging fraud between the lender and a solicitor who had previously acted for them and wrongful changes to mortgage documentation lodged with the Land Registry. On 8 July 2022, a panel of three Supreme Court judges declined to hear the Gilroys' appeal, finding no point of general public importance and that their due process rights had been fully vindicated in the lower courts.
