latest first- High Court hears challenge to Kratom supply charge in Wicklow Possession of a controlled drug (Kratom) for supply · Co. Wicklow
Ronan Maguire, a man from Wicklow town, was charged on 11 September 2019 with possession of 1kg of Kratom for supply at the Primary Healthcare Centre, Drumkay Road, Wicklow. He denies the charges. The original Section 15A charge, carrying a minimum 10-year sentence based on the Garda valuation of €20,000, was withdrawn by the DPP, leaving a simple possession charge. A Circuit Court judge rejected the defence's application for disclosure of the valuation basis, saying it would be for a jury to decide whether the Kratom was for personal use or supply. In November 2022, Maguire brought a High Court judicial review challenging the Garda valuation, arguing the substance costs between €180 and €300 in countries where it is legal.
