latest first- Supreme Court allows sexual assault claim against late solicitor to proceed Sexual assault
In 1981, Stephen Beatty, a 15-year-old man, alleges he was sexually assaulted by his father Walter Beatty snr, a prominent Irish lawyer who served as president of the Law Society. Walter Beatty snr denied any wrongdoing during a Garda investigation and was charged with indecent assault in October 2019, but the prosecution was withdrawn after he became incapacitated. Stephen Beatty initiated civil proceedings in 2022 seeking damages; the High Court dismissed the case as unfair to proceed, and the Court of Appeal reversed that decision. Walter Beatty snr, who was 89 and suffering from severe cognitive impairment when proceedings commenced, died before the Court of Appeal ruling. The Supreme Court has now dismissed the estate's appeal, allowing the civil damages claim to proceed.
