latest first- High court finds fraud and negligence in Dublin property transfer Fraud (property transfer); professional negligence · Co. Dublin
In 2003, Marie Gibson, a woman in her 80s, and her late husband John Gibson transferred their family home at Castletymon Green, Coolock, Dublin 5, to their daughter Pauline Gibson without receiving any money, a transaction handled by solicitor Kevin O'Gorman who acted for both parties. The fraud was not discovered until 2017 when John Gibson died, and O'Gorman was found to have conducted the transaction in a grossly negligent fashion while Pauline Gibson forged signatures on re-executed documents in 2009/10. Marie Gibson sued O'Gorman, Pauline Gibson, and a receiver appointed over the property, with Pauline Gibson not taking part in the proceedings. In December 2022, Mr Justice Cregan at the High Court found the transfer fraudulent, set it aside, and adjourned the matter to January for quantification of damages.
