Patrick McCarthy, 38, of Rathkeale, was convicted of careless driving after his Hyundai van smashed into a verge twice and ended up on its side in a ditch on the road between Ballingarry Village and Rathkeale on 31 August 2022. He told the court he swerved to avoid hitting a child, but Garda Superintendent Aileen Magner, whose dash cam captured the incident, said she saw no child or anyone else on the road.
