    Patrick Costello, an Irish man and Green Party TD, brought a constitutional challenge in Dublin arguing that the investor court provisions in the EU-Canada trade deal CETA involved an unconstitutional transfer of sovereignty and judicial power contrary to Articles 15 and 34 of the Constitution. The High Court dismissed his challenge in September 2021, but Costello secured a leapfrog appeal to the Supreme Court, which heard arguments in March and June 2022. In November 2022, the Supreme Court ruled by a four to three majority that CETA ratification is unconstitutional as Irish law stands, and by a six to one majority that amendments to the 2010 Arbitration Act could cure the defect.
