  • Offaly recycling directors face committal over alleged contempt of court Contempt of court · Co. Offaly

In September 2021, Mr Justice Simons ordered that the Oxigen Environmental waste recycling facility at Barnan, Daingean, Co Offaly could only accept construction and demolition waste. Residents Elaine Kelly Dunne, Noel Moore, Ann Flynn, David Kelly, Annette McGrath, Lousie O'Sullivan, Claire Moore Matt Kelly and Michael Kelly brought High Court proceedings against Guessford Ltd, trading as Oxigen Environmental, alleging the facility was in persistent breach of the order by processing commercial, timber and municipal waste. On 18 February 2022, Mr Justice Simons granted the residents permission to bring a motion for the attachment and possible committal to prison of the company's directors Sean Doyle and Alan Doyle for alleged contempt of court. The matter was set to return before the High Court early the following week.
