  In October 2015, Joe Costello made comments on the Saturday with Claire Byrne radio broadcast that a High Court jury later found defamatory of Nicky Kehoe. In 2018, the jury awarded €10,000 overall, finding RTÉ 35 per cent liable and Costello 65 per cent at fault, with Kehoe receiving €3,500 against RTÉ. Costello, a current Dublin City Councillor, claims RTÉ used him as a concurrent wrongdoer in its defence without notifying him of the proceedings. He brought a damages claim against RTÉ and the State for breach of fair procedures and good name and reputation, which the High Court allowed to proceed after dismissing RTÉ's strike-out application in December 2021. The case is now on trial in the High Court in Dublin.
