latest first- Supreme Court rules calculated grades exclusion breached constitutional rights Constitutional rights (education; calculated grades) · Co. Mayo
Two home-schooled students, 18-year-old Elijah Burke from Co Mayo and 18-year-old Naomi Power from Fiddown, Co Kilkenny, were excluded from the 2020 Leaving Certificate calculated grades scheme. The High Court found in their favour and both were subsequently awarded calculated grades. Minister for Education Norma Foley appealed the decisions through the Court of Appeal and the Supreme Court. On 24 January 2022, the Supreme Court ruled that the exclusion was an impermissible interference with the constitutional freedom of the family to provide education in the home.
