latest first- Court of Appeal upholds Minister's residency card refusal Residency (refusal of residency card – dependency test)
A Pakistani widow, Mrs Kauser, who has lived in Ireland with her son since 2016, had her residency card refused by the Minister for Justice. The High Court quashed the refusal, finding the Minister had not applied the correct legal test for dependency. The Court of Appeal, in a judgment by Ms Justice Aileen Donnelly, overturned that decision on 20 December 2021, ruling the Minister had applied the correct test and was not required to consider emotional and social dependence. The Minister was awarded her legal costs.
