Mark Jenkins, who operates two 'Re-Leaf' businesses selling hemp and CBD products in Clonmel, Tipperary and Dungarvan, Waterford, faces three sets of charges under the 1977 Misuse of Drugs Acts for possession of cannabis with intention to supply, arising from Garda searches in February and July 2020 and a checkpoint stop in Lismore, Waterford in May 2020. He challenged the prosecutions in the High Court, arguing they breach his constitutional rights and EU law because EU regulations permit products with small amounts of THC to be legally traded. In May 2022, Ms Justice Egan granted a stay on the first set of charges only, finding an arguable case that the February 2020 material complies with EU regulations, while the May and July 2020 charges proceed.
