  • Brothers awarded €95,000 each for malicious prosecution in Dublin Malicious prosecution · Co. Dublin

Two brothers, Italian Marco Gambucci and his brother Luca, were arrested and charged with theft in May 2008 while gardaí investigated an attempted handbag theft in Grafton Street, Dublin. The criminal case was struck out after the gardaí failed to attend court, and the brothers subsequently sued gardaí Daniel Barry and Jonathan Petrie, the Garda Commissioner, and the State for malicious prosecution. A previous hearing in the civil action ended in a hung jury and the case was set down for retrial. In May 2024, a High Court jury found the prosecution was brought for the improper purpose of dissuading the brothers from seeking legal redress and awarded Marco €95,000 and Luca €95,317.
