latest first- High Court refuses to overturn replanting order in Cork tree-felling case Breach of replanting order; unauthorised tree-felling (forestry regulation) · Co. Cork
Lorraine Costello, who has land at Silvergrove, Kilbarry, Co Cork, was granted a five-year tree-felling licence with her husband James Costello, but following neighbour complaints and a forestry inspector's visit in October 2017, the Minister revoked the licence in February 2019 and issued a replanting order in March 2019. Ms Costello challenged both decisions in the High Court, arguing the bodies acted in breach of fair procedures. In November 2021, Mr Justice Cian Ferriter refused to grant the relief sought, finding she had not provided a good and sufficient reason for not bringing the challenge sooner. Criminal proceedings for an alleged breach of the replanting order, instituted by the Minister in August 2020, stood adjourned pending the High Court's judgment.
