  • Conviction quashed in New Ross fire safety case Fire safety (failure to ensure safety in the event of a fire) · Co. Wexford

Leslie Peacock, a 75-year-old man, was convicted in January 2015 of failure to ensure safety in the event of a fire at Kennedy Plaza Apartments in North Quay, New Ross, Co Wexford, where a fire broke out on 20 January 2012. The fire alarm did not sound during the blaze after a resident disabled it by removing the fuse and batteries with a screwdriver at about 12.40am. The five-storey building contained 24 apartments and was occupied by 32 residents at the time. The Court of Appeal rejected both grounds of appeal but quashed the conviction in July 2022, expressing concern about the trial judge's direction to the jury, and ordered a retrial adjourned to 4 October 2022.
