  • Oral rape conviction upheld on appeal in Dublin Rape (oral rape) · Co. Dublin

    Jose Lacerna Pena, a 33-year-old man originally from Bolivia, orally raped a woman on Wicklow Street, Dublin 2, on 26 September 2017. The victim had been at a nightclub with friends and was making her way across the city centre when the attack occurred, and two young men passing by intervened to end it. Pena was arrested, pleaded not guilty at the Central Criminal Court, and was found guilty by a jury before being sentenced to six years' imprisonment in April 2020. The Court of Appeal dismissed his appeal in November 2021, finding the trial judge's direction on consent was fair and balanced.
