latest first- High Court dismisses cohabiting couple's pension claim in Tipperary Social welfare (cohabiting couples' rights) · Co. Tipperary
Michelle Batey died on 31 January 2021 from Covid-19, which she contracted in December 2020 while vulnerable due to breast cancer diagnosed in 2018. Her partner of over 20 years, Johnny O'Meara, a self-employed agricultural plant contractor from Toomevara, Co Tipperary, was refused the Widower's Pension in April 2021 because the couple were not married. O'Meara and his three children brought judicial review proceedings against the Minister for Social Protection, which were heard in the High Court on 5 and 6 July 2022. Justice Mark Heslin dismissed the claim, ruling that cohabitation is not a qualification for the pension and that it is the role of the Oireachtas to decide who benefits.
