latest first- Supreme Court discontinues injunction over Ennis trespass case Trespass; unauthorised development (planning) · Co. Clare
The McDonaghs, including woman Helen McDonagh and a man, moved their caravans and mobile homes onto council-owned lands at Cahercallamore, Ennis, Co Clare in 2017 after their previous home at the Ashline traveller development was destroyed by fire. Clare County Council secured a mandatory injunction in 2019 claiming the family was in unlawful occupation of a green field site, and the Court of Appeal upheld the injunction in 2020. In January 2022, the Supreme Court discontinued the injunction, finding the lower courts erred in concluding the McDonaghs had not raised a fair case and highlighting the vulnerability of the Irish Traveller community and the council's duty as a housing authority.
