latest first- Fitzgerald fraud claim in High Court as possession case struck out Fraud (alleged); possession proceedings · Co. Clare
Davy Fitzgerald, a man from Sixmilebridge, Co Clare, claims his name was placed on false mortgage documentation for six or seven properties in Portugal without his knowledge or consent, and that former ACC Bank official Jarlath Mitchell entered his name on the false mortgages. Fitzgerald is fighting possession proceedings by Pepper Finance and a receiver aimed at securing a property at Clonlara, Sixmilebridge, where his sister Helen Fitzgerald lives. He has sued ACC Loan Management and Mitchell in the High Court seeking damages for alleged fraud, negligence and deceit. The possession case against Fitzgerald and his sister was struck out on 25 October 2022 due to non-appearance by the plaintiffs' representatives. Deputy Master John Glennon said the case would most likely be reinstated on appeal or the summons reissued.
