latest first- First mica blocks case admitted to Commercial Court in Donegal Defective products · Co. Donegal
A husband and wife couple from Malin Head, Co Donegal, are suing over damage from concrete blocks containing mica used to build their home between 2005 and 2008. They are bringing proceedings against Cassidy Brothers Concrete Products Ltd of Buncrana, Donegal County Council, and the NSAI, claiming the blocks were not fit for purpose and that the certification and surveillance bodies failed in their duties. The case first came before Mr Justice Denis McDonald on 21 November 2022, who postponed the decision on Commercial Court admission to January. On 30 January 2023, the case was admitted to the fast-track Commercial Court as one of five pathfinder cases in the mica controversy.
