latest first- High Court grants possession order in Delgany mortgage arrears case Possession (mortgage arrears); duress (alleged) · Co. Wicklow
George Raymond allegedly threatened his wife, a woman named Ruth, with physical violence in the kitchen of their Delgany, Co Wicklow, home in June 2006 to make her sign a €800,000 loan secured on the family home. Bank of Ireland Mortgage Bank sought possession of the home based on arrears of more than €1 million, and the Circuit Court granted a possession order in March 2019. On appeal, the High Court, with Mr Justice Garrett Simons presiding, granted a possession order with a six-month stay for Mrs Raymond to arrange alternative accommodation. The enforceability of the second €800,000 loan was referred to a plenary hearing.
