latest first- Assault charges dismissed in Cork case over student ejected from house Assault · Co. Cork
George Pendle, a student, told Cork District Court that 62-year-old Daniel Lynch and his 32-year-old son Donal Lynch burst into his bedroom at 4 Nursery View, Glasheen Road, Cork city, around 8.30am on 11 August 2022, manhandled him, slapped him in the face, and put him out of the house in his underwear. Both men were charged with assaulting Pendle and fellow occupant Olivia Lehane, attempting to commit theft of a phone, and trespassing to commit theft. Both men denied the charges, and the defence said the occupants had not paid any rent. On 19 December 2023, Judge Marian O'Leary dismissed all charges, saying the prosecution had not proven the men were trespassers and that the men were entitled to use proportionate force against those who had not paid rent.
