Cases
latest first- Gemma O'Doherty contempt of court case adjourned in High Court Contempt of court · Co. Cavan
Edel Campbell of Kingscourt, Co Cavan, sued Gemma O'Doherty, editor of The Irish Light, over the unauthorised use of her late son Diego Gilsenan's image in an article linking unexplained deaths to the Covid-19 vaccination. The High Court granted an injunction in June 2023 restraining O'Doherty from harassing Campbell, and it is alleged the order was subsequently breached through social media posts. Contempt proceedings seeking O'Doherty's committal to prison have been repeatedly adjourned, most recently in June 2024 to early July, as O'Doherty is out of the jurisdiction and gardaí have made 20 efforts to locate her. O'Doherty denies all wrongdoing and claims the plaintiff has broken the law on champerty and maintenance.
In court, 23 Jun 2023Accused, suspect · 7 reports - Contempt of court application adjourned at Dublin High Court Contempt of court · Co. Dublin
Gemma O'Doherty, a journalist, was arrested by gardaí and brought before the High Court in Dublin on 10 April 2024 facing a contempt of court application. The application alleges she made statements in video posts in breach of an injunction obtained by Edel Campbell, a woman from Kingscourt, Co Cavan, whose son took his own life. The injunction restrains O'Doherty from harassing or intimidating Campbell, and the underlying civil proceedings concern the use of an image of Campbell's deceased son in the Irish Light newspaper. O'Doherty denied the harassment claims, said the injunction should never have been granted, and was released from Garda custody after the hearing. The judge adjourned the application to later that week to allow O'Doherty to obtain legal representation.
In court, 10 Apr 2024Suspect · 1 report - O'Doherty convicted of breaching Covid travel rules in Cork Breach of Covid 19 regulations (travelling between counties) · Co. Cork
Gemma O'Doherty, a 54-year-old former journalist from Shankill, Dublin, travelled to Cork on 12 December 2020 to attend an anti-lockdown protest in the Grand Parade. She addressed the crowd at 4.25pm, insisting the virus was a hoax and that RTÉ was spreading lies on behalf of the Government, and the group also went outside RTÉ Cork studios and to the office of then Tanaiste Micheal Martin on Evergreen Road. She was charged with breaching a penal provision of a regulation made under Section 31(A) of the Health Act, 1947. In November 2022 she was convicted in her absence at Cork District Court and fined €750, with five months to pay. She had three previous convictions.
Convicted, 16 Nov 2022Convicted · 2 reports - Appeal withdrawn in Kilmacanogue public order case Public order (threatening and abusive behaviour; resisting arrest; refusing to give name and address) · Co. Wicklow
On 28 August 2020, Gemma O'Doherty, a 54-year-old woman, was arrested on a footbridge on the N11 at Kilmacanogue, Co Wicklow, in connection with anti-facemask and anti-vaccination banners that distracted motorists. She was convicted at Bray District Court on 29 September 2021 of threatening and abusive behaviour, resisting arrest, and refusing to give her name and address to Garda Andrew Sullivan and Joseph Waldron. Judge David Kennedy imposed a two-month suspended sentence and a fine of €750. O'Doherty lodged an appeal, which she withdrew at Wicklow Circuit Criminal Court on 17 October 2022.
Sentenced, 29 Sep 2021Convicted · 4 reports - Supreme Court dismisses constitutional challenge to lockdown laws in Dublin Constitutional challenge (lockdown laws) · Co. Dublin
John Waters and Gemma O'Doherty challenged the constitutionality of 2020 emergency Covid-19 lockdown laws in Dublin, claiming the measures were a grossly disproportionate response to a disease they disputed was dangerous. The High Court refused them leave for judicial review in May 2020, and the Court of Appeal dismissed their appeal in March 2021. A seven-judge Supreme Court panel heard the limited appeal in March 2022, focusing on rights and proportionality. In July 2022, the Supreme Court voted six to one to uphold the dismissal, with Mr Justice Gerard Hogan dissenting.
