latest first- Court of Appeal quashes search warrant over journalist's phone in Roscommon Search warrant (journalistic privilege) · Co. Roscommon
Gardaí searched the home of Emmett Corcoran, editor of The Democrat newspaper in Strokestown, Co Roscommon, under a warrant issued on 2 April 2019 in connection with an investigation into violence at a repossessed house in December 2018. Corcoran invoked journalistic privilege and refused to provide his phone's PIN. The High Court ruled in September 2020 that he could not rely on journalistic privilege and that a limited examination of the phone was justified by the public interest in investigating criminal offences. The Court of Appeal in April 2022 quashed the warrant, finding that journalistic privilege was not properly taken into account before it was issued, and ordered the phone returned to Corcoran with all data excluded from the gardaí's investigation.
