latest first- Supreme Court to hear appeal on journalist search warrant in Roscommon Search warrant (journalistic privilege) · Co. Roscommon
A phone was seized from the home of journalist Emmet Corcoran, editor of The Democrat, during a Garda investigation into violence at a repossessed house in Falsk, Strokestown, Co Roscommon, in April 2019. Mr Corcoran had switched the phone off and refused to provide the PIN before it was taken. The High Court ruled in 2020 that gardaí could access the phone's contents, but the Court of Appeal overturned that decision in April 2022, quashing the search warrant and ordering the phone returned to Mr Corcoran. The Supreme Court agreed in October 2022 to hear the Garda Commissioner's appeal, finding it raises important issues on the balance between criminal investigation and journalistic privilege.
