latest first- Prisoner loses High Court challenge to prison discipline sanction in Laois Prison discipline (High Court challenge to sanction) · Co. Laois
Michael Murray, 51, formerly of Killiney, Co Dublin, was convicted in 2013 of the rape and sexual assault of a woman and later found guilty by a Circuit Criminal Court jury of threatening to kill barristers Dominic McGinn SC and Tony McGillicuddy SC and harassing them, his rape victim, and his former solicitor by advertising them online as prostitutes. He was sentenced to 16 years at the Criminal Courts of Justice in late July 2021, where he threw a bible at Judge Karen O'Connor and was excluded from the hearing. The governor of Midlands Prison, Portlaoise, Co Laois, imposed a 40-day removal of ordinary privileges as a disciplinary sanction in early August 2021. Murray challenged the sanction in the High Court, arguing the governor was not entitled to discipline him as the misconduct occurred while he was in the custody of the court. Mr Justice Charles Meenan dismissed the action in December 2022, ruling the governor was lawfully entitled to impose the sanction.
