Declan Service, a businessman from Portrush, Co Antrim, aged 62 or 63 depending on the report, is alleged to have sold shares in Open Orphan plc between 18 and 22 May 2020 after being told confidentially of a plan to issue new shares at a discount. He was arrested by appointment in early June 2023 following a market abuse investigation by the Garda National Economic Crime Bureau, and was charged with two counts of insider dealing at Bridewell Garda station before appearing at Dublin District Court, where he was granted bail. In October 2023 he pleaded guilty at Dublin Circuit Criminal Court to one of the two counts, in what was reported as the first insider trading conviction in the State. On 20 December 2023 Judge Elma Sheahan said she was considering a sentence of eighteen months, with a review on 19 February 2024 and a requirement that Service lodge €69,310 with his solicitor to fund a fine.
