Asha Iqbal was charged with theft of items valued at €242 from Creative Care Social Enterprise, Shannonside Retail Park, Carrick-on-Shannon, Co Leitrim, on 13 March 2018. The shop manager Dawn Walsh reported the theft after gardai found household items on the path outside the shop. The case was heard before a jury in Carrick-on-Shannon Circuit Court, where the judge found the prosecution had failed to seek the defendant's phone records as requested during her interview. On 26 November 2021, Judge John Aylmer withdrew the case from the jury and acquitted Iqbal, citing the Supreme Court decision in DPP v Braddish on the duty to gather all relevant evidence.
