latest first- Supreme Court reserves judgment on Shannon Airport trespass appeal Trespass (with intent to commit criminal damage) · Co. Clare
Edward Horgan, 76, of Newtown, Castletroy, Limerick, and Dan Dowling, 40, of Grace Dieu, Waterford City, were charged with defacing a US Navy aircraft with graffiti and trespassing at Shannon Airport on 25 April 2017. The men were tried at the Circuit Court in Dublin from June 2022, acquitted of criminal damage but convicted of trespass in January 2023. Dowling's appeal to the Supreme Court, heard in April 2026, argued that the defence of necessity applies to a trespass charge under section 11 of the Criminal Justice (Public Order) Act 1994. Chief Justice Donal O'Donnell reserved judgment.
