  • Appeal court dismisses MDS claim in Sligo careless driving death case Careless driving causing death; road traffic incident (fatal) · Co. Sligo

A lorry driven by Vlastimil Zachar, 47, a Czech national from Newbridge, Co Kildare, hit Sligo County Council workers cutting hedges and clearing drains on the N4 near Castlebaldwin on the morning of 13 August 2015, killing 63-year-old Padraig Noone and injuring Damien Davey and colleagues. Zachar was fined and banned from driving for seven years for careless driving causing death, and was later diagnosed with obstructive sleep apnoea. Seven legal actions were brought over the crash. The Court of Appeal has dismissed an appeal by MDS Distribution Ltd, confirming the council bore no liability and that the truck company and driver bore full responsibility for the crash.
