latest first- Man wins Data Protection Act breach case in Dublin Breach of Data Protection Act 1988 · Co. Dublin
Graffiti was carved into a table in the staff tearoom of Our Lady's Hospice and Care Services in Harold's Cross, Dublin, on 19 November 2015. Gardaí advised the hospice to review CCTV footage, and Cormac Doolin, a craftsman's mate at the hospice, was identified on the footage entering the room and subsequently disciplined for taking unauthorised breaks. Doolin complained to the Data Protection Commissioner that the use of the CCTV data breached the Data Protection Act 1988, arguing the footage was gathered in relation to the graffiti and should not have been used for an unrelated disciplinary matter. The Court of Appeal ruled in Doolin's favour on 25 May 2022, dismissing the DPC's appeal and ordering the DPC to pay both sets of legal costs.
