latest first- Appeal dismissed over Limerick bridge crane safety fines Health and safety offences (fatal incident) · Co. Limerick
On 29 August 2015, two stonemasons, Bryan Whelan, 29, from O'Briensbridge, Co Clare, and Timothy O'Herlihy, 36, from Castleisland, Co Kerry, drowned when a steel cage suspended from a crane plunged into the River Shannon at Thomond Bridge, Limerick city, while a third worker, Paul Murphy, 26, from Askeaton, was rescued after freeing himself from his harness. The Health and Safety Authority found the crane's overload protection safety system had failed, causing the wire cable to snap. Nationwide Crane Hire Limited and Palfinger Ireland Limited pleaded guilty to breaches of the Health and Safety at Work Act at Limerick Circuit Criminal Court on 28 July 2022. On 7 October 2022, Judge Tom O'Donnell fined Nationwide Crane Hire €200,000 and Palfinger Ireland €25,000. The Court of Appeal dismissed the DPP's appeal against the Palfinger fine on 28 July 2023, finding it was not unduly lenient.
