Cases
latest first- Supreme Court to hear appeal in personal injuries guidelines case Constitutional challenge (personal injuries award guidelines) · Co. Waterford
Bridget Delaney, a woman from Dungarvan, Co Waterford, fractured a bone in her right ankle after tripping and falling at a public footpath at Pinewood Estate, Dungarvan, on 12 April 2019. She alleged negligence by Waterford City Council and submitted a claim to PIAB in June 2019. PIAB assessed her claim at €3,000 in May 2021 under new guidelines that came into effect in April 2021, while she claimed the appropriate award was between €18,000 and €34,000. She brought a constitutional challenge against the State, PIAB, and the Judicial Council, arguing the guidelines and their adoption were unconstitutional. The High Court dismissed the challenge in June 2022, and the Supreme Court agreed in December 2022 to hear a leapfrog appeal.
