Brian Fox, a 25-year-old man from Clonlough, Mitchelstown, was found fast asleep in the driver's seat of a Toyota Landcruiser stopped on a regional road at Millmount, Kilmallock, Limerick, at around 1am on 19 July 2021. A garda observed smoke from the front of the vehicle and two males asleep inside, with the keys in the ignition and the engine off. The evidencer machine was not working, so a doctor was called and Fox gave a urine sample reading 207mgs of alcohol per 100mls. He pleaded not guilty to drink driving at Kilmallock Court. On 4 November 2022 the charge was dismissed on the merits because the vehicle was immobile and the defendant was in a deep sleep.
