latest first- High Court stays Kerry council ethics investigation Governance (council ethics complaint; conflict of interest in voting) · Co. Kerry
A complaint was made earlier in 2021 against Cllr Breandán Fitzgerald, a Fianna Fáil councillor for the Castleisland-Corca Dhuibhne electoral area in Co Kerry, alleging a conflict of interest in his voting on an aspect of a draft local area plan for Corca Dhuibhne. The council opened an investigation under Ethics Legislation, initially led by cathaoirleach Cllr Jimmy Moloney and chief executive Moira Murrell. Fitzgerald denies any wrongdoing and says he has no interest or connection with the lands in question. On 30 November 2021, the High Court, through Mr Justice Charles Meenan, granted a temporary stay on the investigation at Fitzgerald's request. Fitzgerald intends to seek permission to bring full judicial review proceedings against the council.
