Defence Forces Captain Alan Kearney applied for the Captain of the Guard post in February 2021 and accepted an offer of appointment on April 7, subject to Taoiseach approval and Garda vetting. On November 26, he was told the Commission of the Houses of the Oireachtas was not proceeding with his nomination. Kearney brought judicial review proceedings claiming his nomination was cancelled in breach of his rights, along with proceedings against the Garda Commissioner over the security clearance process and against the Minister for Justice and the State. On December 10, Mr Justice Charles Meenan in the High Court placed a temporary stay on the Taoiseach appointing a new Captain of the Guard, with the case set to return in January.
