Woman pleads not guilty to failing to leave Tullamore crime scene

Ashling Murphy, a 23-year-old schoolteacher, was fatally assaulted at about 4pm on Wednesday 12 January 2022 on the bank of the Grand Canal at Cappincur, Tullamore, County Offaly, and gardaí believed it was a random attack. A man in his 40s, described as a Romanian national, was arrested that day and released without charge on the Thursday evening after a possible mistake in identification, and Radu Floricel, 39, the brother of Neara Tanase, was also arrested at the same residence and later eliminated from enquiries. Neara Tanase, 27, was charged with failing to comply with a Garda direction to leave a designated crime scene at her Tullamore home on 12 January 2022, and appeared at Portlaoise District Court on 13 January, where she was remanded with bail conditions. At Tullamore District Court on 19 January she pleaded not guilty, and the prosecution was adjourned to 6 April 2022.

Cause
Gardaí believed the injuries were consistent with an assault and that it was a random attack, with the victim and the man arrested not knowing each other.
Investigation
  • A man in his 40s, described as a Romanian national who had lived in Tullamore for several years, was arrested on 12 January and detained at Tullamore Garda Station under Section 4 of the Criminal Justice Act 1984.
  • The man denied any involvement and was released without charge on Thursday 13 January after a possible mistake in identification, and gardaí said he was no longer a suspect.
  • Radu Floricel, 39, was arrested at the same residence on 12 January, detained for questioning, released the following Thursday, and gardaí said he had been eliminated from their enquiries.
  • An incident room was set up at Tullamore Garda Station under a Senior Investigating Officer, with over 50 gardaí assigned, and a family liaison officer was appointed.
  • The scene was preserved overnight, the canal bank was sealed off, and gardaí appealed for information from people in the Cappincur canal walk area before 4pm on 12 January and for a Falcon Storm mountain bike with straight handlebars and yellow/green front forks.
  • On 17 January gardaí removed one of eight bottle banks at the Daingean Road car park by crane, suspecting it may hold evidence, and a number of vehicles were seized.
  • Key facts record that one man was arrested on 18 January and questioned in Tullamore, and another man was arrested in the east of the country on 19 January.
Charges
Neara Tanase, 27, was charged with failing to comply with a Garda direction to leave a designated crime scene at 21 Cluain Darragh, Daingean Road, Tullamore, on 12 January 2022, contrary to Section 5(4) of the Criminal Justice Act 2006.
In court
  • At Portlaoise District Court on 13 January, before Judge Catherine Staines, Tanase said she was using her right to remain silent, and she was remanded in custody to Dochas Women's Prison with consent to bail on her own €100 bond on condition she stay away from the address.
  • Sources differ on what followed: one says Tanase did not take up bail and was held in custody, while another says she was released on bail after her brother was released from Tullamore Garda Station.
  • At Tullamore District Court on 19 January, Tanase pleaded not guilty, her solicitor Donal Farrelly asked for a benign approach, and the prosecution was adjourned to 6 April 2022.
