Case No. 30001Assault · Co. Roscommon · 28 Apr 2009

Supreme Court upholds costs order in Roscommon assault case

On 28 April 2009, John Matthews, a wildlife ranger with the National Parks and Wildlife Service, and Gerard Gearty were involved in an altercation at Cloonart near Roosky, County Roscommon. Both men were subsequently prosecuted for assault by the gardaí acting for the DPP before the District Court in Leitrim, but the DPP directed that both prosecutions be withdrawn on the second day of the hearing. The District Court judge struck out the prosecutions and ordered the DPP to pay their legal costs. The DPP successfully challenged the costs order in the High Court, but the Court of Appeal overturned that decision earlier in 2021. The Supreme Court has now dismissed the DPP's appeal, upholding the District Court's costs order in favour of the two men.
