Case No. 2490Residential tenancy dispute (civil – maintenance of common areas) · Co. Dublin

Tenant loses High Court appeal over landlord's duty to maintain common areas in Swords

Leonardo De Oliveira Lima lost his High Court appeal claiming landlord Jersia Ltd was obliged to maintain the common areas of the Applewood Village apartment complex in Swords, Co Dublin. Mr Justice Barry O'Donnell refused the appeal, finding the RTB tribunal did not err in determining the landlord's responsibility did not extend to common areas managed by a separate management company.
