Supreme Court upholds murder conviction over Bobby Ryan killing in Tipperary

Bobby Ryan, a part-time DJ known as Mr Moonlight, was last seen leaving Mary Lowry's home early on 3 June 2011 in Tipperary. His remains were found on 30 April 2013 in a disused underground run-off tank on a farm leased by Patrick Quirke, a married man from Breanshamore, at Fawnagowan, and Quirke was arrested afterwards. A jury convicted Quirke of murder in 2019 by a 10:2 majority, and he was sentenced to life imprisonment. In March 2023 the Supreme Court ruled that the seizure and search of a computer from his home was unlawful, and on 28 July 2023 it dismissed his appeal, affirmed the conviction and rejected a retrial.

What happened
  • Bobby Ryan was a part-time DJ known as Mr Moonlight.
  • Patrick Quirke is a married man from Breanshamore in Tipperary, and sources give his age as 51 in one report and 53 in another.
When
Mr Ryan went missing on 3 June 2011 after leaving Mary Lowry's home early that morning, reportedly around 6.30am.
Where
Mr Ryan's naked body was found on 30 April 2013 in a disused underground run-off tank on a farm owned by Mary Lowry and leased by Quirke at Fawnagowan, Co Tipperary.
Cause
  • Mr Ryan died from blunt force trauma with injuries to his head, ribs and leg.
  • The prosecution argued that Quirke murdered Mr Ryan, his love rival, so he could rekindle an affair with Mary Lowry.
Other details
  • One expert not called by the DPP said the trauma could have been caused by vehicular impact, while the DPP's expert accepted this was possible but said there was no evidence to support it.
  • The prosecution argued that Quirke staged the discovery of the body because he was about to give up his lease on the farm; Quirke denies murdering Mr Ryan.
Investigation
  • Quirke was arrested after Mr Ryan's remains were found, and his home was searched on 17 May 2013.
  • A computer seized from Quirke's home showed internet searches on the decomposition of human remains and the limits of forensic DNA, and gardaí believed he was looking for information on how to get away with murder.
Charges
Quirke pleaded not guilty to Mr Ryan's murder.
In court
  • In 2019 a jury at the Central Criminal Court convicted Quirke of murder by a 10:2 majority verdict after a trial lasting 13 weeks, although some reports give 15 weeks or 71 days.
  • The Court of Appeal dismissed all 52 grounds of challenge in November 2021, but the Supreme Court agreed to hear a further appeal.
  • In March 2023 the Supreme Court ruled that the search warrant was lawful but the seizure and search of the computer's contents was unlawful, and it later heard submissions in May 2023 on the consequences, including a defence request for a retrial.
  • On 28 July 2023 the Supreme Court unanimously dismissed the appeal, found the breach resulted from honest inadvertence and affirmed the conviction, rejecting the request for a retrial.

Supreme Court (seven-judge panel, unanimous) allowed Quirke's appeal on the ground that the search warrant under section 6 of the Criminal Justice Act 2006 did not authorise a digital search of computers, as the sworn information only referenced personal items of the deceased and 'any other relevant evidence'. The second ground (DPP's failure to call one of four pathology experts) was dismissed. Submissions on consequences to be heard on a later date.
