Case No. 0046Constitutional challenge

Supreme Court reserves judgment in super junior ministers challenge in Dublin

Pa Daly and Paul Murphy, two opposition TDs, challenged the attendance of super junior ministers at Cabinet meetings, arguing it breaches Article 28 of the Constitution which limits government members to 15. A three-judge High Court heard the cases in July 2025 and dismissed both challenges on December 19, 2025, finding no constitutional provision restricts Cabinet attendance to the 15 ministers. The TDs were awarded 50 per cent of their legal costs against the State due to the importance and complexity of the issues. The Supreme Court, sitting as a seven-judge panel, heard the appeal from October 21 to 23, 2026, and reserved its judgment on October 23, 2026.
