Case No. 26909Divorce (ancillary provision; property) · 11 May 2022

Man's divorce property appeal dismissed in High Court

In 2008, judicial separation proceedings gave the woman custody of the couple's children, each party one family property, a division of monies, and separate pension arrangements. The man, who received a tax-free lump sum of about €75,000 upon retirement that year, spent thousands on un-prescribed drugs, alcohol, and Panamanian goods, and lost the residence ordered to him. In 2021, the Circuit Court made an ancillary provision order continuing the 2008 order. The man appealed to the High Court, arguing he had not been granted proper provision. On 11 May 2022, Mr Justice Max Barrett dismissed the appeal, finding the man had dissipated his capital through poor and improvident decisions.
