Man fails to halt sister's civil damages claim over alleged rape and sexual abuse
A woman has brought a civil damages claim against her older brother, alleging he raped and sexually assaulted her on some 120 occasions when she was between 11 and 13, more than 40 years ago. In 2023 she initiated civil proceedings in the High Court seeking damages for the alleged assaults. The man made a pretrial application to strike out the case, arguing the delay of more than 40 years created a real risk of an unfair trial and that key family witnesses had died. In August 2025, Mr Justice Anthony Barr dismissed the application, finding no culpable delay by either side and no real risk of an unfair trial.
