Court of Appeal upholds €25,000 fine on crane company over Limerick bridge drownings
Two men, Bryan Whelan (29) of O'Briensbridge, County Clare, and TJ O'Herlihy (36) of Castleisland, County Kerry, died on 29 August 2015 when a steel cage suspended from a crane plunged into the river Shannon while they were doing cleaning and repointing work on Thomond Bridge in Limerick city. Palfinger Ireland Ltd, which supplied the crane, pleaded guilty to breaches of the Health and Safety at Work Act and was fined €25,000 at Limerick Circuit Court on 7 October 2022. Nationwide Crane Hire Ltd was separately fined €200,000 after pleading guilty to breaches of the same Act. The Director of Public Prosecutions appealed the Palfinger fine as unduly lenient, but the Court of Appeal dismissed the appeal and found the sentence was not unduly lenient, a ruling reported on 28 July 2023.
