Court of Appeal rejects undue leniency appeal over Ballingarry crash sentence
On 14 August 2021 a collision occurred at Ballingarry, Co Tipperary, in which a five-year-old girl suffered a very severe traumatic brain injury. Emmett Rigney, aged 22, was convicted of dangerous driving causing serious bodily injury by Judge Catherine Staines at Nenagh Courthouse on 26 April 2024. He received a headline sentence of three and a half years, reduced to two years and suspended for two years on payment of €10,000 compensation, and was disqualified from driving for six years. The DPP appealed the sentence on grounds of undue leniency, and on 3 April 2025 the Court of Appeal dismissed the application, finding the sentence was not unduly lenient.
